These Terms of Use (the "Terms") set forth the conditions for use of the apparel sales website operated by NOBUOKA Holdings, LTD. (the "Company"). By using the website, users are deemed to have agreed to these Terms.

The website is primarily operated for international sales. However, these Terms may also apply to access and orders from Japan. Users are responsible for confirming the laws, import restrictions, customs procedures, taxes, and other requirements applicable in their own country or region.

Users shall not engage in any of the following acts when using the website:

1. Any act that violates applicable laws, regulations, or public order and morals.
2. Any criminal act or any act related to criminal activity.
3. Any act that infringes the rights, interests, reputation, or credit of the Company, other users, or any third party.
4. Any act that places an excessive burden on servers, networks, or systems, or any unauthorized access or attempted unauthorized access.
5. Registering or transmitting false or misleading information.
6. Orders placed for resale, fraudulent purposes, or in quantities beyond ordinary personal use.
7. Any act that interferes with the operation of the website or any other act the Company reasonably deems inappropriate.

All copyrights, trademarks, design rights, and other intellectual property rights relating to the text, images, logos, product photographs, videos, layouts, and all other content displayed on the website belong to the Company or the rightful owners thereof.

Users may not reproduce, modify, repost, distribute, transmit, or otherwise use any such content beyond the scope permitted by law, including private use exceptions.

The Company may display product descriptions, pricing, stock information, specifications, sizes, colors, materials, shipping destinations, and other information on the website, but does not guarantee the completeness, accuracy, or timeliness of such information.

Actual colors and textures may differ from the on-screen appearance depending on the shooting environment, device, and display settings.

Prices, specifications, sales conditions, and availability are subject to change without prior notice. In the event of an obvious pricing error, the Company may cancel the relevant order even after order confirmation.

An order submitted by a user shall not be deemed final merely upon receipt of an order acknowledgment. A sales contract shall be formed when the Company issues a shipment completion notice or any other equivalent notice of acceptance.

Shipments are primarily made for international destinations, and the Company uses DHL as its carrier. Delivery may be delayed or rendered impossible due to country-specific conditions, customs clearance, weather, social circumstances, or other factors.

Unless otherwise required by law or expressly stated by the Company, customs duties, import taxes, customs handling charges, and other public charges arising from importation shall be borne by the customer.

The Company makes no representation or warranty, express or implied, regarding the continuity, availability, safety, error-free operation, fitness for a particular purpose, or absence of viruses or other harmful elements on the website.

The Company shall not be liable for any damages arising from communication failures, system outages, maintenance, suspension of third-party services, misdelivery, customs procedures, import restrictions, force majeure, or any other cause not attributable to the Company.

Even where the Company is liable for damages, unless caused by the Company's wilful misconduct or gross negligence, the Company's liability shall be limited to the total amount actually paid by the customer for the relevant order, including shipping fees received by the Company.

The Company shall appropriately handle personal information obtained in connection with the use of the website in accordance with the separately established Privacy Policy.

The Company may amend these Terms where reasonably necessary due to changes in laws, the content of services, operational needs, or other legitimate reasons. Any amendment shall take effect when posted on the website or on a separately specified effective date.

These Terms and the use of the website shall be governed by the laws of Japan.

Any dispute between the Company and a user relating to the website or these Terms shall be submitted to the court having jurisdiction over the location of the Company's head office as the court of first instance with exclusive agreed jurisdiction.
